Notice for Contractors

Notice of Privacy Practices for Contractors Residing in California (the “Notice”): For purposes of this Notice, the terms “we,” “our” and “us” refer to Tandem Diabetes Care, Inc., a Delaware corporation.

Introduction and Scope

This Notice is drafted to comply with the California Consumer Privacy Act (“CCPA”) and our own Data Privacy Program. This Notice applies to our contractors who reside in California. “Contractor” includes all individuals that provide services to Tandem pursuant to a written agreement.

Types of Personal Information Collected

Over the past twelve months, we have collected, or may have collected, personal information from you, including without limitation some of the following data:

Personal Identifiers

Such information includes full name, home address, email address, telephone number, photographs, signatures, online identifiers, Social Security number, and information collected for purposes of public health (such as body temperature).

Professional Information

Such information includes:

  • Information Relating to your Professional : government-maintained disciplinary records (such as exclusions lists); and to the extent voluntarily provide by you, your education history, employment history, and curriculum vitae.
  • Service Administration Information: description of services to be provided, compensation amount and frequency of payment, bank account and routing numbers if you chose and are able to be paid via direct deposit, independent contractor agreements, training records, user names and passwords and similar online identifiers if access to Tandem’s network is necessary, emergency contact telephone numbers, and tax information;
  • Performance of Services : facts reported through a whistleblowing hotline or regulatory reporting channel, content of professional emails to the extent permitted by applicable law, system-generated logs regarding internet, email, and telephone use should you be permitted to access Tandem’s network, date and time of access card use if you are provided with one, and CCTV security surveillance footage when you are physically present on Tandem premises.

Purposes of Collection and Use

We use your information for managing your relationship with Tandem and for administrative business purposes, including:

  • Carrying out and supporting our financial and governmental reporting functions and activities;
  • Fulfilling our obligations under independent contractor agreements and/or applicable laws;
  • Managing workplace and public safety and health;
  • Administering tax reporting obligations;
  • Creating and managing global metrics to ensure and evaluate the quality of your services to Tandem customers;
  • Complying with our legal obligations and internal policies, including those that relate to information security and data privacy practices;
  • Managing internal complaints or claims and litigation;
  • Managing and conducting our business activities, including allocating company assets and human resources, project management, records management and compilation of audit trails or other reporting tools, managing mergers, acquisitions, sales, re-organizations or disposals and integration with a purchaser; and
  • Operating IT and communication systems and monitoring your email and Internet usage to the extent permitted by applicable law if you are permitted to use Tandem’s network.

Information Sharing and Transfers

To achieve the purposes for which we use your information as explained in section 4, we may disclose your personal information to third parties, including:

  • To our subsidiaries and affiliates;
  • To vendors, business partners, and service providers that perform services on our behalf, such as
    • hiring and placement support;
    • human capital management;
    • compensation processing;
    • travel planning;
    • registration and licensing with governmental and regulatory authorities;
    • DMV status confirmation; and
    • global information systems services and support.
  • In the event Tandem sells or transfers all or a portion of its business or assets (including in the event of a merger, acquisition, joint venture, reorganization, dissolution or liquidation), your information may be among the assets transferred to the buyer or acquirer;
  • If required to do so by law or legal process;
  • In response to lawful requests from public authorities, including to meet national security, public interest or law enforcement requirements.

Tandem does not sell your personal information to anyone.

Data Security

We employ reasonable and appropriate technical, administrative and physical safeguards designed to protect your information from loss, misuse and unauthorized access, disclosure, alteration and destruction, taking into due account the risks involved in using the information.

Changes to this Policy

As our business evolves and as California privacy laws and regulations change, it may be necessary to revise or update this Notice. When we do so, we will also revise the "last updated" date at the top of this Notice, and the new version will be made available to you.
